Terms & Conditions

General

At all times PicoGirl endeavours to make a valid sale according to the customer’s order and to provide ongoing support, yet circumstances in incorrect cataloguing, stock availability, and numerous other issues may occur that result in a failure to provide such a service. Consequently, by shopping with PicoGirl you as the Customer are declaring agreement with the Seller to be bound to these terms and conditions. 


Acceptance

No obligation shall arise until PicoGirl accepts the order from a Customer seeking to make a purchase.

Refunds

Customers can cancel an order prior to shipping and a full refund will be given as soon as deemed possible by the Seller.

Returns

Items can be returned and at our best efforts they will be refunded excluding postage costs, yet it remains the Sellers legal prerogative to accept or reject a refund of any returned product whether full or in part and according to any circumstance.

PicoGirl provides support by email, and telephone for customers

Delivery

PicoGirl will use reasonable endeavours to meet delivery estimates but cannot accept any liability whatsoever for a failure to do so however arising.

Law

Any sale transacted by PicoGirl is to be governed solely by Australian Law and the parties agree to submit to the exclusive jurisdiction of the Australian courts.

Limitation of Liability

  1. The Customer will be responsible for ensuring the fitness for purpose of the products for the Customer’s application unless the purpose is previously notified to PicoGirl in writing.
  2. PicoGirl accepts no liability whatsoever or howsoever arising in respect of loss, damage or expense arising from errors in information or products or advice provided whether or not due to PicoGirl's negligence or that of its employees, agents or sub-contractors save for any loss or damage arising from personal injury.
  3. PicoGirl shall not be liable to the Customer by reason of any representation (unless fraudulent), or any implied warranty, condition or other terms, or any duty at common law, or under the express terms of the contract with the Customer, for any indirect, special or consequential loss or damage (whether for loss of profit or otherwise), costs, expenses or other claims for compensation whatsoever (whether caused by the negligence of PicoGirl, its employees or agents or otherwise) which arise out of or in connection with the supply of the products or their use or resale by the Customer.
  4. The entire liability of PicoGirl under or in connection with the contract with the Customer shall not exceed the price of the products except as expressly provided in these terms and conditions.
